Terms of Service

These Terms of Service (“Terms”) are an agreement between you and Nexboro (“Nexboro”, “we”, “us”). They cover nexboro.com, the preview sites we publish, and the website design, hosting and related services we provide (the “Services”). By using the Services or paying for them, you agree to these Terms. If you are agreeing on behalf of a business, you confirm that you are authorized to bind that business.
Short version: we build your preview for free. If you like it, you pay a monthly fee that covers design, hosting and small edits. You can cancel at any time, and your site stays live until the end of the period you've paid for. See Refunds and Cancellation for the details.
1. Our services
Nexboro designs, builds and hosts websites for local service businesses. Depending on your plan, the Services may include website design and copywriting, hosting and SSL certificates, connecting your domain, contact and quote forms, basic local search setup and ongoing small edits. The features included in your plan are described in your order, quote or invoice.
2. Free previews
We may build a free preview of a website for your business, either at your request or on our own initiative using information your business has made public. A preview is free and creates no obligation. Previews are published at private, unlisted web addresses and are marked so they are not indexed by search engines. Previews use stock or placeholder content until you approve your own. You can ask us to take a preview down at any time.
3. Pricing and payment
- Prices. Prices are quoted in U.S. dollars (USD) and are shown in your quote, order or invoice before you pay. Unless stated otherwise, prices do not include taxes. Where required, we add applicable sales tax.
- Subscriptions. Website plans are billed as a recurring subscription, monthly or annually, in advance. Your subscription renews automatically at the end of each billing period, and you authorize us to charge your payment method on file for each renewal until you cancel.
- One-time fees. Some work, such as a setup fee, a large redesign or a domain registration, may be billed once. We will always tell you the amount before you are charged.
- Payment processing. Payments are processed securely by Stripe. By paying, you also agree to Stripe's terms. We do not store your full card number.
- Failed payments. If a payment fails, we will notify you and retry. If it is still unpaid 14 days after the due date, we may suspend the website until the balance is paid.
- Price changes. We will give you at least 30 days' notice by email before a price change applies to your subscription. You can cancel before the new price takes effect.
4. Delivery of services
The Services are delivered online. No physical goods are shipped. After you approve your preview and make your first payment, we usually publish your website within 5 business days, provided we have what we need from you (for example, access to your domain). Edit requests are usually completed within 2 business days. These are targets, not guarantees, and we will tell you if something will take longer.
5. Cancellation
- You can cancel your subscription at any time by emailing us at the address in the Contact us section. We will confirm your cancellation in writing.
- Cancellation takes effect at the end of your current billing period. Your site stays live until then, and you will not be charged again.
- There are no cancellation fees and no long-term contracts, unless you chose a prepaid annual plan (see Refunds).
- When you cancel, we will hand over your content, images and site files, and help you move your domain, at no extra charge if you ask within 30 days of cancellation.
6. Refunds
- Preview first. You see a working preview of your site before you pay anything, so you know what you're buying.
- First payment. If you're not satisfied, you can request a full refund of your first payment within 14 days, as long as the site has not yet been published on your domain.
- Monthly plans. After that, monthly fees are non-refundable, and we don't give refunds or credits for partial months. You can cancel at any time to stop future charges.
- Annual plans. If you cancel a prepaid annual plan, we will refund the unused full months, minus any discount you received for paying annually.
- One-time fees. One-time fees are refundable in full if you cancel before work begins. Domain registration fees paid to a third-party registrar are non-refundable.
- Billing errors. If we charge you in error, such as a duplicate charge or a charge after cancellation, we will refund it in full.
To request a refund, email us at the address in the Contact us section. Approved refunds are returned to your original payment method within 5–10 business days. Your bank may take longer to post them.
7. Billing questions and disputes
If you have a question about a charge, please contact us first. We will review it and respond within two business days, and most problems can be fixed quickly. If you file a chargeback or payment dispute with your bank, we may suspend the Services while it is reviewed, and we will provide the bank with records of the Services and our communications with you.
8. Your content and ownership
- You own your content. Your business name, logo, photos, text and domain remain yours. You give us permission to use, copy, modify and display your content only as needed to provide the Services.
- Your site. Once your fees are paid, the content and design of your website are yours to keep, and we will hand them over if you leave. Our underlying templates, code and tools remain ours, and you receive a license to use them as part of your website.
- Your responsibility. You confirm that you have the rights to the content you give us, and that your content and business information are accurate and lawful.
- Stock images. Stock images we provide are used under their licenses and may only be used on your website.
- Portfolio. We may show your published site in our portfolio unless you ask us not to.
9. Acceptable use
You may not use the Services to publish or send content that is illegal, fraudulent, deceptive, defamatory or infringing; to sell goods or services prohibited by law or by our payment processor; to distribute malware or spam; or to interfere with our systems or other customers' sites. We may remove content or suspend a site that breaks these rules. Where possible, we will tell you first and give you a chance to fix it.
10. Domains and third-party services
Domain names are registered in your name or, where we register them for you, transferred to you on request. Some features rely on third parties, such as domain registrars, booking tools, map providers and payment processors. Their own terms apply, and we are not responsible for their services.
11. Hosting and availability
We work to keep sites online and secure and to fix problems quickly, but we do not guarantee uninterrupted service. Planned maintenance is scheduled for low-traffic hours where possible. We keep regular backups of the sites we host, but you should keep copies of any content that is important to you.
12. Disclaimers
Except as stated in these Terms, the Services are provided “as is” and “as available”. To the fullest extent permitted by law, we disclaim all implied warranties, including merchantability, fitness for a particular purpose and non-infringement. We do not guarantee any particular search ranking, number of calls, leads or sales.
13. Limitation of liability
To the fullest extent permitted by law, Nexboro will not be liable for any indirect, incidental, special, consequential or punitive damages, or for lost profits, revenue or data. Our total liability for any claim relating to the Services is limited to the amount you paid us in the 12 months before the claim arose. Some jurisdictions do not allow these limits, so they may not apply to you.
14. Indemnification
You agree to defend and indemnify Nexboro against third-party claims arising from content you provided, your business or your breach of these Terms.
15. Suspension and termination
We may suspend or end the Services if you seriously or repeatedly breach these Terms, do not pay, or if we are required to by law. If we end the Services for reasons other than your breach, we will refund any prepaid fees for the unused period and help you move your site.
16. Governing law and disputes
These Terms are governed by the laws of the United States and of the state in which Nexboro is organized, without regard to conflict-of-law rules. Before filing a claim, each party agrees to try to resolve the dispute informally by contacting the other for at least 30 days. Nothing in these Terms limits any rights you have under consumer protection laws that cannot be waived.
17. Changes to these terms
We may update these Terms from time to time. We will post the updated version on this page and change the “Last updated” date. If we make material changes, we will email active customers at least 30 days before they take effect. If you keep using the Services after that, you accept the updated Terms.
18. General
These Terms, together with your order, quote or invoice and our Privacy Policy, are the entire agreement between you and Nexboro about the Services. If any part of these Terms is found unenforceable, the rest remains in effect. If we don't enforce a provision right away, we have not waived it. You may not transfer these Terms without our consent. Export and sanctions laws may restrict use of the Services in certain countries, and you agree to comply with them.
